Understanding the Impact of Food Waste Legislation in England

It has now been a year since the Simpler Recycling reforms changed the legal landscape for businesses across England. As of March 2026, we are entering the next critical phase of the rollout.

The business landscape: One year in

Since 31 March 2025, it has been a legal requirement for most businesses and non-household premises (with 10+ employees) to separate food waste from all other waste.

Where we stand today:

  • 10+ Employees: You should already have separate collections in place.

  • Micro-businesses (<10 Employees): You are still in your transition period. Your deadline is 31 March 2027, but many are already switching early to avoid the "last-minute rush" for bins and collections.

1. Hygienic Bin Swaps are currently only available on 60lt bins in specific areas. It is our intention to expand this to all areas in Sussex for both our 60lt and 240lt bin sizes. This will be subject to round density of weekly collections schedules. 2. No weight limits bins is an early bird offer to the first eighty eight (88) 240lt bins ordered. Thereafter, the next 44 will benefit from a maximum weight limit of 150kg, followed by 125kg for the following 44 bins ordered. Our standard weight limit of 110kgs will then apply to all further bins ordered. Additional weight will be charged at 7p per kg. 3. Bin deliveries are due to be rolled out week commencing 6th April 2026. Services required before this date will be considered on a case by case basis. 4. All orders are subject to minimum 12-month agreement. 5. Annual Compliance charge of £25 applies to each site. A single Compliance charge covers all non-hazardous waste streams collected by NuWaste. 6. All offers are subject to minimum order quantities being reached. Where these minimum quantities are not reached, we reserve the right to remove any offer at any time.
